BY SUBSCRIBING TO OR USING THE TRADER PATH, YOU ACKNOWLEDGE AND AGREE THAT THIS IS PURELY AN EDUCATIONAL PROGRAM. WE DO NOT PROVIDE FINANCIAL ADVICE, INVESTMENT ADVICE, OR TRADING SIGNALS. NO FINANCIAL RESULTS ARE GUARANTEED. YOU PARTICIPATE ENTIRELY AT YOUR OWN RISK.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," "your") and The Trader Path, operated by Damian Kruszewski ("we," "us," "our"). By creating an account, subscribing to our program, accessing our community, or using any of our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use our Services. If you are accessing the Services on behalf of a business or entity, you represent and warrant that you have the authority to bind that entity to these Terms.

All content, materials, live sessions, feedback, community discussions, and mentoring are provided exclusively for educational and informational purposes.
2.2 Not Financial Advice
Nothing contained in our program, website, community, live sessions, materials, communications, or any other aspect of our Services constitutes:

• Investment advice or investment recommendations
• Trading signals, calls, or entry/exit recommendations

• A solicitation, recommendation, endorsement, or offer to buy or sell any financial instruments

We make no representations, warranties, or guarantees of any kind regarding the results you may or may not achieve from using our educational program. Any examples, case studies, demonstrations, or references to performance — whether by us, our mentors, or other members — are provided strictly for illustrative and educational purposes and do not represent a guarantee, promise, or prediction of your results.

Your results depend entirely on your individual effort, discipline, experience, financial situation, market conditions, and numerous other factors over which we have no control. Past performance of any individual, strategy, or method — whether discussed in our program or not — is not indicative of future results.

4. Subscription and Payment
4.1 Subscription Model
The Trader Path operates on a monthly subscription basis at the price displayed at the time of purchase (currently $39.99 USD per month). Subscriptions automatically renew each month until cancelled by you.
4.2 Payment Processing
Payments are processed through third-party payment processors (e.g., Stripe via Whop). We do not directly store your full payment card details. All payment processing is subject to the terms and conditions of the respective payment processor.
4.3 Price Changes
We reserve the right to change subscription pricing at any time. Existing subscribers will be notified at least 30 days before any price change takes effect. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.
4.4 Cancellation
You may cancel your subscription at any time through the Whop platform or by contacting us. Upon cancellation:
• You will retain access to the program until the end of your current billing period.
• No further charges will be made after cancellation.
• We do not provide prorated refunds for partial billing periods.
4.5 Refund Policy
Due to the digital nature of our educational content and the immediate access provided upon subscription, refunds are generally not provided. However, we may consider refund requests on a case-by-case basis at our sole discretion. If you believe you are entitled to a refund, please contact us within 7 days of your most recent payment.
4.6 Currency and Taxes
All prices are listed in US Dollars (USD). You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction. Currency conversion fees, if applicable, are your responsibility.
5. User Obligations and Conduct
5.1 Eligibility
You must be at least 18 years of age to use our Services. By subscribing, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
5.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5.3 Prohibited Conduct
You agree not to:
• Share, distribute, reproduce, resell, or publicly display any program content, materials, or proprietary methods without our prior written consent.
• Record, screenshot, or otherwise capture live sessions, group calls, or mentoring sessions without explicit permission.
• Share your account access with any third party.
• Use our Services to provide financial advice, trading signals, or investment recommendations to others.
• Misrepresent your results or claim that outcomes achieved through our program are guaranteed or typical.
• Harass, intimidate, threaten, or abuse other community members, mentors, or staff.
• Post spam, promotional content, or unsolicited advertisements within our community.
• Engage in any activity that violates applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or extract proprietary methods or algorithms from our educational materials.
• Use our educational content, brand name, or materials to create competing products or services.
5.4 Community Guidelines
Our community is an educational environment. All members are expected to treat each other with respect and professionalism. We reserve the right to remove any member who violates these guidelines without a refund.
6. Intellectual Property
6.1 Ownership
All content provided through our Services — including but not limited to course materials, videos, frameworks, models, methodologies, analyses, live session recordings, written materials, graphics, logos, and the overall structure of the program — is the exclusive intellectual property of The Trader Path and Damian Kruszewski, protected by copyright, trademark, and other intellectual property laws.
6.2 Limited License
Upon subscribing, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the program content for your personal educational purposes only. This license does not include the right to:
• Copy, modify, distribute, or create derivative works from any content
• Use content for any commercial purpose
• Share access with non-subscribers
• Republish or publicly display any materials
6.3 License Termination
This license terminates automatically when your subscription ends or is terminated. Upon termination, you must cease using and delete any downloaded materials from our program.
6.4 User Content
By submitting analyses, messages, or other content to our community, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and share that content within our educational platform for the purpose of providing feedback and facilitating community learning.
7. Testimonials and Member Stories
Any testimonials, case studies, or member stories shared on our website, community, or marketing materials:

• Are shared with the explicit consent of the respective members.

8. Limitation of Liability
8.1 General Limitation
To the maximum extent permitted by applicable law, The Trader Path, Damian Kruszewski, and our officers, directors, employees, agents, affiliates, successors, and assigns shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:
• Loss of profits, revenue, data, or business opportunities
• Financial losses from decisions made in financial markets
• Loss of goodwill or reputation
• Cost of procurement of substitute services
• Any damages arising from your use of or inability to use our Services
8.2 Maximum Liability
In no event shall our total aggregate liability to you for all claims arising from or related to these Terms or our Services exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless The Trader Path, Damian Kruszewski, and our affiliates, officers, agents, employees, and contractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
• Your use of or access to our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any decisions you make or actions you take in financial markets
• Any content you submit or share through our platform
• Any misrepresentation you make regarding our Services or your results
10. Dispute Resolution
10.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us and attempt to resolve any dispute informally for at least 30 days.
10.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. For users outside Poland, mandatory consumer protection laws of your jurisdiction may also apply to the extent they cannot be waived.
10.3 Jurisdiction
Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts located in Poland, unless mandatory consumer protection laws in your jurisdiction require otherwise.
10.4 Class Action Waiver
To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
11. Disclaimer of Warranties
Our Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We specifically disclaim all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing, usage, or trade practice.
We do not warrant that:

• Our Services will be uninterrupted, timely, secure, or error-free
• The results obtained from using our Services will be accurate, reliable, or beneficial
• Any errors in our Services will be corrected

12. Termination
12.1 Termination by You
You may terminate your account and subscription at any time by cancelling through the Whop platform or by contacting us.
12.2 Termination by Us
We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason, including but not limited to:
• Violation of these Terms or our Community Guidelines
• Sharing, redistributing, or reselling program content
• Abusive or disruptive behavior within our community
• Fraudulent activity or unauthorized use
• Non-payment of subscription fees
12.3 Effect of Termination
Upon termination, your right to access the Services ceases immediately. Sections 2, 3, 6, 7, 8, 9, 10, and 11 shall survive termination.
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet outages, server failures, or third-party platform disruptions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Trader Path regarding the use of our Services, and supersede all prior agreements, understandings, and communications.
14.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
14.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

These Terms are drafted in English. In the event of any conflict between the English version and any translated version, the English version shall prevail.
